Judge issued Bail Bondsmen ‘Blank Check’

A St. Louis judge signed more than a dozen blank bail bonds for three commercial bondsmen to use while the judge was vacationing in Ireland last summer, a Globe-Democrat investigation shows.
Judge Richard J. Brown of the St. Louis Court of Criminal Correction, signed 14 separate blank bonds and apparently divided them between bondsmen Carl Biondo and Bernard and Irwin Crouppen before Brown’s three-week trip to Ireland in July and August last year…
In effect the judge signed his name to a “blank check” which allowed the bondsmen to write in the name of any person he wanted to and subsequently gain the release of that individual from police custody for any amount the bondsmen designated.
At first Brown said he “couldn’t recall ever having done such a thing” but later admitted that he may have given out a blank “bond or two with my signature.”…
When asked how a blank bond scheme could occur, Crouppen added:
“I can’t answer you about something I have no answer for.”
One St. Louis judge with more than 30 years on the bench had said that “gratuities” from a bondsmen to a judge may be a possible cause for some bail bond irregularities.” …

Study Committee to Meet in St. Louis

The next public hearing of the bail bond industry study committee will be held this Tuesday, October 27, 2009, at the MODOT building located at 1590 Woodlake Drive, Chesterfield, MO. The hearings will be conducted from 9:00 pm to 12:00 pm.The DIFP requests that individuals wishing to testify call 573-751-2562 at least one day prior to hearing. Written testimony and comments will also be accepted.

John M. Huff Named to Director Position at DIFP

 

JEFFERSON CITY, MO – – John M. Huff has been confirmed by the Missouri Senate to become the Director of the Missouri Department of Insurance, Financial Institutions and Professional Registration.  Governor Jay Nixon selected Huff as his choice for director earlier this month, selecting him to lead the state agency which oversees several aspects of financial markets in the state.  Mr. Huff’s sixteen years of insurance experience will be utilized in protecting Missouri insurance consumers and investors in light of the current difficult economic times.

“I am honored to have been chosen as the director of this department.  At this time in our state’s history, it is of the highest importance to enact measures that not only protect consumers, but also allow for fair business,” stated Mr. Huff.  “I will utilize the experience I have in the industry to make sure our department does everything in its power to provide consumers the protection they need and deserve, as well as promote Missouri as a great place to conduct business.”

For the past several years, Mr. Huff has worked at Swiss Re, a leading provider of reinsurance in the industry.  In his role as managing director and strategic claims officer, he oversaw matters within the company’s strategic and emerging claims portfolio.  In 2008, Mr. Huff was promoted to the position of global head of key case management and moved to Swiss Re’s global headquarters in Zurich, Switzerland.  In this position, he managed some of the company’s most-complex dispute resolution matters.

Mr. Huff earned his bachelor’s in business administration at Southeast Missouri State University. In May 1987, he earned an MBA at St. Louis University, and he graduated from the Washington University School of Law with a juris doctorate in May 1990. Mr. Huff and his wife, Donna Phelps, have an eight-year-old daughter, Ann Huff.
The department is the chief regulator in the state of Missouri for insurance, banks, credit unions, and various professional licenses.  The agency is divided into seven divisions, with four of those divisions overseeing the insurance market in this state.

Bail Scammers Target Restaurants

A bail bond scam was reported to authorities in Conway, AR. According to the Log Cabin Democrat, a manager of a Waffle House received a phone call early Sunday morning from a man who identified himself as Brandon Clay and said he was a bondsman. The man said that he was at a Pulaski County jail with one of her employees, who had been injured in a car accident, and asked the manager for $220 to bond the man out. A few hours after the manager transferred the money, she told police, she found out that the employee had been at home asleep the whole time. A check of Arkansas licensing records reveals that there is no Brandon Clay licensed as a bondsman.The identical scam was reported in Florida last month. Impersonators targeted restaurants, reporting that an employee had been arrested. The restaurants wired the money only to find out later that the named employee had never been arrested. Police report that it is difficult to find the accused scammers because the entire transaction was conducted by telephone.How to avoid this scam: Check state licensing records. Almost all states have licensing records online. In Missouri, you can find them here. Call law enforcement authorities where the bond is located. Confirm that the co-worker or loved one is in custody and the person calling is an agent in that area. Check the yellow pages for bail bond companies.

New Missouri Bail Association Formed

In response to the legislative threats last legislative session, several bail bond agents around the state met together to oppose legislation sponsored by the MPBBA which would transfer the DIFP’s authority to a bail bond board. In order fund the new board, the bill required a new $10 bail bond tax. The group received tremendous help from concerned agents who collected hundreds of signatures opposing the legislation. The bill failed, the session ended, and the group decided to form a bail association. In June, Associated Bail Agents of Missouri, Inc.  (ABAM) was formed. The association is a non-profit trade association. Bart Cooper serves as the association president, Stan Clark as vice-president, Dave Strassner  as treasurer, and Angela Park  as secretary. The board of directors are Tina Bozarth , Dan Mense, Stan Moreland, Mike Thomas  and Jim Walker. Rick Adams serves as chair of membership. ABAM will work as legislative watch-dogs in the upcoming session and will give bondsmen and recovery agents a new choice in order to network cooperatively with their colleagues in the industry. This new, spirited association is working on other goals to improve our industry and give us all more opportunities to grow our businesses.
